Originally, a court date was scheduled for the 18th of december. June had been set. However, this date has now been postponed by more than two months, as SAP AG announced in walldorf on tuesday. "Due to scheduling conflicts on the part of the oracle legal team, the court date was moved to 27. August 2012 moved."

The legal dispute is already entering its fifth year after oracle found the damages awarded last year too low. A jury had awarded the u.S. Software company $1.3 billion, but judge hamilton found the amount "extremely excessive" and trimmed it to $272 million. As a result, oracle had decided to reopen the proceedings.

The transgressions in question were committed a long time ago. The employees of the SAP subsidiary tomorrownow, which was taken over in 2005 and has since been closed down, had downloaded updates from oracle in a grossly unlawful manner. The san francisco district attorney’s office found at least 6249 cases and fined sap 20 million dollars, which the germans paid without complaint.

SAP has long since admitted its wrongdoing and apologized publicly. The germans are also prepared in principle to compensate oracle for the damages. But opinions differ on the amount of just compensation: SAP offers millions, oracle demands billions. The two companies are fierce competitors in business software and databases.

Europe’s major software maker, meanwhile, has rewarded itself with a jump in profits after a record quarter. In the three-month period from april to june, profit after taxes climbed 12 percent year-on-year to 661 million euros. SAP made the announcement in walldorf on tuesday – and thus opened the round of figures for the 30 dax companies for the second quarter of 2012.

SAP had already presented its first key data almost two weeks ago: according to this data, the group increased its sales in the second quarter by 18 percent to 3.9 billion euros – the highest figure ever achieved in this period. The software company reported a seven percent increase in operating profit over the previous year, to around 921 million euros.
